เงื่อนไขการเข้าร่วม Workshop และข้อยกเว้นความรับผิด

1. Introduction

These Workshop Terms and Conditions ("Workshop Terms") govern your attendance at any workshop, seminar, demonstration, or training session ("Workshop") offered by Peera Lertsukittipongsa trading as Painkiller School through the Platform at painkiller.school.

By completing a Workshop booking, you confirm that you have read, understood, and agree to these Workshop Terms in their entirety. These Workshop Terms are incorporated into and must be read alongside our Terms of Service and Refund Policy.

2. Booking and Confirmation

A Workshop booking is confirmed only upon: (a) receipt of full payment of the listed booking fee; and (b) delivery of a written booking confirmation to your registered email address. Bookings are subject to availability.

3. Attendance Requirements

You agree to arrive (in-person) or connect (online) on time. We are not obligated to replay content or provide compensatory sessions for late arrivals. We reserve the right to remove any participant (without refund) whose behavior is disruptive, aggressive, or violates our code of conduct.

4. Physical Activity and Health Disclosure

PKS workshops may involve physical demonstrations, anatomy education, and hands-on exercises related to musculoskeletal anatomy and movement.

By booking a Workshop, you represent and warrant that you are physically able to participate and that if you have any pre-existing medical conditions, injuries, or physical limitations, you will disclose these to the Facilitator prior to the start of the Workshop.

The educational content and physical demonstrations in our Workshops are for learning and educational purposes only. Nothing in any Workshop constitutes medical advice, physiotherapy treatment, or any form of regulated healthcare. You should consult a licensed medical professional before undertaking any physical activity program.

5. Liability Waiver and Disclaimer

You acknowledge that your participation in any Workshop, including any physical activities, demonstrations, or exercises, is entirely voluntary. You participate at your own risk.

To the fullest extent permitted by applicable law, by booking and attending a Workshop, you:

• Waive any and all claims arising out of or in connection with your participation in the Workshop, including but not limited to claims arising from personal injury, accident, illness, property damage, or death;
• Release and discharge Peera Lertsukittipongsa, his employees, agents, contractors, and representatives from all such claims; and
• Agree to indemnify and hold harmless Peera Lertsukittipongsa from any claims brought by third parties arising from your conduct during the Workshop.

Nothing in this waiver limits liability for: (a) death or personal injury caused by the gross negligence or willful misconduct of Peera Lertsukittipongsa; or (b) any liability that cannot be waived or excluded under applicable Thai law.

In the event of a medical emergency during an in-person Workshop, the Facilitator will take reasonable steps to contact emergency services (191/1669).

6. Cancellation by Peera Lertsukittipongsa

We reserve the right to cancel or reschedule any Workshop at any time due to illness of the Facilitator, force majeure events, insufficient enrollment, venue unavailability, or any other circumstance that makes it impractical to proceed. In the event of cancellation by us, we will follow the procedure set out in Section 3.4 of the Refund Policy. We are not liable for any consequential, incidental, or indirect losses you suffer as a result of our cancellation.

7. Cancellation by Participant

Where a participant cancels within 7 calendar days of the scheduled Workshop date, no refund is available. A credit note may be considered entirely at our own sole and absolute discretion on a strictly case-by-case basis. No credit note will be issued automatically. See Section 3.2 of the Refund Policy for full terms.

8. Consent to Recording and Photography

Workshops may be recorded (audio and/or video) by us for purposes including quality review, content production, and promotional use. By completing your Workshop booking, you give your consent for us to record the Workshop session and use such recordings in marketing and promotional materials.

If you do not consent to being recorded or photographed, you must notify us in writing at [email protected] at least 24 hours before the Workshop start time. If exclusion is not feasible, we will offer you a full refund in lieu of attendance.

9. Intellectual Property in Workshop Materials

All Workshop materials are the intellectual property of Peera Lertsukittipongsa and are protected under the Copyright Act B.E. 2537 (1994). You may not record the Workshop yourself without our prior written consent, reproduce or distribute Workshop materials, use Workshop materials for commercial purposes, or use Workshop content to train, fine-tune, or develop any artificial intelligence model.

10. Governing Law

These Workshop Terms are governed by the laws of the Kingdom of Thailand. Any disputes arising from or related to these Workshop Terms shall be resolved in accordance with the dispute resolution mechanism set out in our Terms of Service.
